AST regulations adopted
The Division of Environmental Quality is informing the public of the adoption of regulations for aboveground storage tanks effective July 30, 2005.
The regulations apply to aboveground storage tanks that contain petroleum products and are greater than 500 gallons in capacity. The regulations are intended to prevent and address sources of pollution that may result from AST systems.
New AST systems constructed after the effective date of these regulations must comply with: permit requirements; location requirements; industry construction and installation standards; AST tightness testing requirements; spill containment requirements; standards for corrosion and overfill protection for AST’s and piping; leak detection and recordkeeping requirements for ASTs and piping; release requirements; and temporary and permanent closure requirements.
For aboveground storage tank constructed before July 30, 2005, an AST Permit to Operate must be completed and submitted to the Division of Environmental Quality within twelve months of July 30th.
