Man sued for selling, leasing out properties ‘with no clean’ titles

Nine persons yesterday sued a landowner who had leased out or sold several parcels of land to them when he allegedly has no clean title to the properties.

The complaint against George L. Teregeyo alleged that he had falsely represented to the nine persons that he had clean title to the properties and had induced them to engage in transactions with him.

The plaintiffs include couples Eduardo and Helen Caranzo, Joe Reb and Jasmine Diaz, Ruel and Luzviminda Villacrusis, brothers Michael Fidelino Lashley and Jun Christopher Fidelino, and Dan Ray Hernandez.

Their lawyer, Timothy Bellas, said Teregeyo had failed to obtain and execute a deed of partition of property among himself and his siblings to remedy the defect in his titles to the parcels of land that became subject of transactions with the plaintiffs.

Teregeyo allegedly represented that he was owner of seven lots in Kannat Tabla, which were subdivisions from two lots. From Aug. 31 to September 2004, Teregeyo allegedly executed and delivered various leases and deeds to the plaintiffs purporting to convey 55-year leases or fee simple interests.

Specifically, Teregeyo leased out one 546-sqm lot each to the Caranzos, Diazes and Hernandez, each of whom fully paid rent of $5,000. Teregeyo allegedly leased out two parcels of 546-sqm lots to the Villacrusises, who paid the rents in full in the amount of $10,000.

Bellas added that Teregeyo conveyed ownership of two parcels of land to the Fidelino brothers, each of whom paid the seller $5,000.

Bellas asked the Superior Court to compel Teregeyo to remedy defects in his titles to the properties. Alternatively, the lawyer asked the court to compel Teregeyo to pay the plaintiffs damages in the amount of $35,000 and punitive damages of $250,000 for the alleged fraudulent representation that he has clean titles to the properties being leased out or sold.

The lawyer also asked the court to award attorney’s fees and costs incidental to the lawsuit in favor of the plaintiffs and against Teregeyo.
