Worker faces possible deportation

A man is now facing deportation proceedings at the Superior Court after being convicted of driving under the influence of alcohol last year.

Investigation conducted by the Immigration agents showed that the court had also convicted Elmo E. San Pedro in two other DUI charges in 1998.

An alien may be deported from the CNMI upon conviction on two misdemeanor charges, such as DUI.

Assistant attorney general Ian Catlett petitioned the court for an order directing San Pedro to show cause why the worker should not be deported from the CNMI.

Catlett said San Pedro’s conviction on three DUI charges constituted a violation of the conditions of the worker’s entry permit, the validity of which is supposed to expire on Feb. 19, 2006.

Associate Judge David Wiseman ordered San Pedro to appear at a court hearing on Sept. 15.
