Alien worker barred to work in the CNMI for 5 years

The Department of Labor has ordered the deportation of sewing machine operator and barred her to gain employment in the CNMI for five years, after using a fake federal labor document that allowed her to obtain temporary work authorizations from the CNMI agency.

It appeared that Zhang Zhie obtained a document using the letterhead of the U.S. Department of Labor, which showed that she had a pending federal labor complaint.

A hearing at the CNMI agency showed that Zhang did not actually file a federal labor complaint, and procured the forged document from a certain Zhou Ying, who had been arrested, prosecuted and deported for involvement in large-scale issuance of fake federal labor documents.

In a recent order, Labor hearing officer Maya B. Kara said that, although Zhou was the main perpetrator of the fraud, Zhang became a knowing participant and benefited from the scheme. Kara ordered the revocation of all temporary work authorizations and memoranda issued by the Labor Department in favor of Zhang.

She said Zhang no longer has a valid immigration status in the CNMI, ordering the worker to leave the islands within 20 days or face deportation. The hearing officer barred Zhang to be employed as a nonresident worker in the CNMI for five years.

Kara’s order noted that Zhang entered the CNMI under a work permit issued on May 5, 2002. Kara said Zhang last permit under the employment of Jin Apparel, Inc. expired on May 7, 2004.

The hearing showed, however, that Zhang obtained the fake document in 2003 to further obtain work authorizations from the CNMI Labor Department. Between Oct. 20, 2003 and Sept. 27, 2005, Zhang obtained six authorizations to seek employment, Kara said.

Kara said Jin Apparel should be responsible for Zhang’s repatriation, but the hearing officer director the Labor Division to assist in the collection of an airline ticket from the garment firm.
