Man arrested for alleged assault

A man allegedly beat up his common-law-wife at their house in Kagman Monday night.

Martin Sanchez Dela Cruz, 36, was arrested for assault and battery, and disturbing the peace.

During a hearing yesterday, Superior Court associate judge David A. Wiseman imposed a $5,000 cash bail for the temporary release of Dela Cruz.

Police said the victim suffered a large bruise and scratch marks on the right arm.

According to a police report filed in court, Dela Cruz had asked his wife to have sex with him but she refused. Dela Cruz got mad and accused her of having an affair with another man.

The defendant threw things inside the house, causing their children to wake up. Dela Cruz also allegedly slapped and punched the victim in the face. He also allegedly choked her and threw her to the couch.

The beating was witnessed by one of their minor children, police said.

Responding police officers arrested the defendant that day at 12:54am.

The victim told police that Dela Cruz would beat her up whenever he gets drunk. She said she did not report some of the beatings because she was afraid.

After a beating, Dela Cruz would tell her to say that she fell from a lemon tree if anybody asks about her injuries, she told police.

Police said Dela Cruz was twice arrested before for domestic violence involving the same victim.

The defendant was arrested on Aug. 3, 2003 for allegedly pushing and strangling the victim.

On May 13, 2004, he was again arrested for allegedly assaulting and choking her on the hood of a car.
