Guam company sues Rifu Apparel for debt

A Guam company has sued Rifu Apparel Corp. and another corporation and their agent for allegedly refusing to pay the $20,500 balance in purchased merchandise and services rendered.

Carrier Guam Inc. sued Rifu Apparel Corp., Saipan JC Corp., and Choi Hyung Chul for breach of contract.

Carrier Guam, through counsel S. Joshua Berger, asked the Superior Court to order the defendants to pay the balance plus attorney’s fees and interest.

Berger stated in the complaint that Chul, a Korean, was an agent for both Rifu and Saipan JC corporations.

Berger said that on Nov. 4, 2004, Choi, personally and on behalf of Rifu Apparel, accepted a proposal from Carrier Guam for services and merchandise to be rendered at the Rifu Apparel’s jobsite for the total amount of $40,500.

The lawyer said that, on that same day, Saipan JC Corp. issued a check in the amount of $20,000 as partial payment. The check was successfully encashed and all services as specified in the contract were completed, Berger said.

“Defendants are presently in default to plaintiff in the amount of $20,500 plus interest,” he added.
