Law firm sues ex-client for not paying attorney’s fees

A law firm has sued its former client in a paternity and child support case for allegedly refusing to pay attorney’s fees.

Pacific Lawyers, doing business as O’Connor Berman Dotts & Banes law office, sued Paula Sablan Hamilton for breach of contract and unjust enrichment.

Pacific Lawyers asked the Superior Court to order Hamilton to pay $6,817.47 in general damages plus interest, additional attorney’s fees, and court costs.

The plaintiff, through counsel George L. Hasselback, stated in the complaint that on Nov. 1, 2004, the law firm and Hamilton entered into an agreement for Pacific Lawyers to render legal services to Hamilton in a paternity and child support matter.

Hasselback said the legal representation continued through October 2005.

He said that Hamilton agreed to pay attorney’s fees and costs incurred in the course of the legal representation.

The lawyer said the defendant also agreed to reimburse the law firm for all out-of-pocket expenses, including filing fees, court costs, travel expenses and duplication charges.

Hasselback said that Hamilton has defaulted on paying the June 8, 2005, payment and has not made a single payment under the promissory note.

As a result of the legal representation, he said, defendant incurred an unpaid balance in the amount of $6,817.47.
