Company, 2 men sue over coconut tree smashup
A company and two men have filed a lawsuit against a motorist who allegedly caused their vehicle to hit a coconut tree in As Perdido.
Kannat Gardens Inc., Alexander L. Lopez, and Dante C. Roman, sued Joaquin R. Crisostomo for negligence.
The plaintiffs, through counsel O’Connor law firm, asked the Superior Court to order Crisostomo to pay them damages, court costs, and attorney’s fees.
According to the complaint, on July 15, 2008 at 2:25pm, Lopez and Roman were traveling west along As Perdido Road on board a 1999 Nissan Frontier owned by Kannat Gardens.
As the two were about to turn right toward the Recycling Center, a 1992 Mazda B2200 driven by Crisostomo suddenly struck their vehicle at the back.
The impact caused the plaintiffs’ vehicle to move forward and hit a coconut tree.
The complaint said that the impact resulted to injuries to Lopez and Roman, while the Kannat Garden’s vehicle was severely damaged.
An ambulance transported Lopez to the hospital due to his injuries.
The complaint said that the investigation conducted by the Department of Public Safety concluded that Crisostomo was at fault.
