Judge delays sentencing of ex-cop, ex-detention guard

The federal court has postponed the sentencing of a former police officer who pleaded guilty to “ice” trafficking charges and a former detention guard at the Juvenile Detention Unit who pleaded guilty to enticing a minor girl.

U.S. District Court for the NMI visiting judge William Q. Hayes moved back the sentencing hearing for Florencio Quitugua Richards and Tyron Farley Reyes Fitial after the U.S. Probation Office asked for the delay.

Richards’ sentencing hearing is moved from July 12, 2011, to July 22, 2011, at 10:30am; Fitial’s is moved from July 21, 2011, to Sept. 13, 2011, at 9am.

In separate requests filed in court on Tuesday, U.S. Probation Officer Margarita D. Wonenberg said the continuance will allow for the probation officer to complete the presentence report investigation.

Richards was supposed to be sentenced on May 17, 2011, but the court moved it to July 12, 2011, after Wonenberg asked in April to postpone it to allow the completion of the presentence investigation report.

Richards, a former police officer, pleaded guilty on Feb. 9, 2011, to conspiracy to distribute “ice,” distribution of “ice,” and possession of a firearm by a prohibited person.

Fitial, a former detention guard, pleaded guilty on April 19 to enticing a minor, but not the actual sexual penetration.
