Man who slams wife’s head on picnic table gets 5-day jail term
The Superior Court has imposed a five-day prison term on a man who was arrested for repeatedly slamming his wife’s head on a picnic table at their house in Kagman III.
Associate Judge Kenneth L. Govendo sentenced 43-year-old Christopher Magofna to a year in prison, all suspended except for five days, for assault and battery, with credit for time served. That means he will no longer serve further jail time. However, if he commits another crime of domestic violence, the remaining months of his suspended sentence will be re-imposed.
Magofna was placed on supervised probation for two years and required to complete anger management counseling, a parenting class, and any other counseling recommended by the treatment provider or the Office of Adult Probation.
Govendo also prohibited him from consuming or possessing any alcoholic beverages or any illegal drugs during his probation.
Magofna was also directed to perform 100 hours of community service and pay a $200 fine, plus court costs and probation fees.
The Office of the Attorney General had charged Magofna with assault and battery, disturbing the peace, and illegal possession of controlled substance. Magofna, with assistant public defender Matt Meyer, agreed to plead guilty to assault and battery as part of a deal. The remaining charges were dropped.
The case arose from an incident on July 15, 2011, when Magofna grabbed his wife by the shoulder and slammed her head down on a picnic table several times. Police said it was the wife who called police to report the incident.
Police also found a marijuana plant at the house.
