Man who kicked cop, damaged police car gets 30-day sentence

Superior Court Presiding Judge Robert C. Naraja has imposed a 30-day prison term on a man who, while drunk, kicked a police officer and damaged a police vehicle.

Naraja sentenced 37-year-old Joseph Jones Villagomez to a year in prison, all suspended except for 30 days, with credit for time served. Villagomez will start serving his sentence on Sept. 1; he will be released on Sept. 16. He will then be placed on one year of probation.

Villagomez was also required to do 50 hours of community service and pay a $100 fine, $100 probation fee, and $25 court assessment fee. He was also directed to pay $226 in restitution for the cost of repairing the glass at the Department of Corrections, and damage to a police vehicle in an amount to be determined by the Office of Adult Probation.

In March 2010, the Office of the Attorney General charged Villagomez with three counts of assault and battery, two counts of criminal mischief, two counts of disturbing the peace, and one count of resisting arrest.

Villagomez pleaded guilty to assault and battery and criminal mischief as part of a plea deal. The remaining charges were dropped. Villagomez was represented by chief public defender Adam Hardwicke.

The case arose from an incident on Feb. 28, 2010, on Saipan, when Villagomez kicked a police officer’s head, damaged the passenger door of a police car, and broke a window at DOC.

Police officers had responded to a Kagman residence after receiving a call about a disturbance. When the officers arrived, Villagomez, who was drunk, was seen shouting at his sisters.

Villagomez reportedly has a history of resisting arrest and had damaged windows of police cars in the past.
