Judge orders continued detention of ex-convict
The federal court has ordered the continued detention of an ex-convict who has been indicted for possession of a firearm and ammunition.
U.S. District Court for the NMI visiting judge David O. Carter on Thursday granted the request of the U.S. government to remand Justin Funkugub back into the custody of the U.S. Marshal pending further proceedings.
Carter stated that a change with Funkugub’s situation may be heard at the next hearing.
Funkugub’s arraignment will be on Feb. 15, 2012 at 10am.
Assistant U.S. attorney Garth Backe is prosecuting the case. Court-appointed counsel Ramon Quichocho represented Funkugub.
The indictment charged Funkugub with a count of felon in possession of a firearm; a count of possession of a firearm with a removed, altered or obliterated serial number; and a count of felon in possession of ammunition.
The U.S. government noted that Funkugub was convicted on Sept. 21, 2000, of cattle killing.
On Oct. 11, 2011, Funkugub was allegedly caught in possession of a Smith and Wesson .38 caliber snub-nose revolver. The gun’s manufacturer’s serial number had been removed, altered, or obliterated, a violation of U.S. Code, according to the indictment. That same date, Funkugub also allegedly possessed six Winchester Super-X .22 caliber bullets.
In the Superior Court, Funkugub is also facing charges of assault and battery, unlawful possession of a firearm, unlawful possession of ammunition, and disturbing the peace, over the same incident when he allegedly assaulted a relative and fired a handgun in As Teo.
