Insurance firm sues motorist over collision

An insurance company yesterday sued a motorist who figured in a vehicular accident with its client more than two years ago.

The Tokio Marine and Fire Insurance Co Ltd. filed with the Superior Court a civil case against Yuzura Harada, a Saipan resident.

John Osborn, the insurance firm’s lawyer, said Harada’s negligence resulted in a vehicular collision between the latter’s vehicle and that of one Mariano M. Camacho.

The company had issued Camacho a property damage casualty insurance policy and was compelled to pay its client $5,222.72, Osborn said.

The complaint stated that the collision happened on Feb. 13, 2003. It said the collision resulted in damage to Camacho’s car in the amount of $6,088.

Osborn said the company is entitled to recover the amount it paid to Camacho from Harada, whose alleged negligence resulted in the vehicular collision. He also asked the court to assess against Harada costs incidental to the filing of the lawsuit, such as attorney’s fees.
