Employer fined for late renewals

The Department of Labor has sanctioned an employer over a one-month delay in her submission of renewal applications for two workers.

Labor hearing officer Herbert Soll ordered Aida C. Garong to pay $320 as fines for the late filing of the permit applications for workers Carmelito Cabrera and Celia Velasquez.

Soll’s administrative order arose from an appeal filed by Garong and the workers requesting the Hearing Office to reconsider the Division of Labor’s denial of their labor applications.

“At the hearing, the employer described the circumstances that led to the late filing of both renewals and the department representative (Novelyn Tenorio) found the explanation to be adequate to allow for late filings if an appropriate sanction would be ordered,” Soll noted.

He also reported that Tenorio had advised the Hearing Office that the applications were in order and would have been approved if it were not for the month’s delay in filing.

In this light, Soll said the Labor Division’s decision must be modified. He instructed to division to resume processing the applications after the payment of fines of $165 for Cabrera and $155 for Velasquez.
