World Resort sues NYBA, officers for debt

The Saipan World Resort has sued the Northern Youth Basketball Association and three of its officers for allegedly refusing to pay food and related services during the association’s award banquet two years ago.

World Resort sued NYBA and its officers Roslyn Leon Guerrero, George Cruz, and Joe Diaz for breach of contract and violation of the Bad Checks Act.

The hotel, through counsel Michael A. White, asked the Superior Court to order the defendants to pay the $5,400 principal sum plus $2,700 interest and another $2,700 interest pursuant to the Bad Checks Act. The plaintiff also demanded payment for attorney’s fees and court costs.

Saipan Tribune learned yesterday that Guerrero is no longer an officer of the NYBA, while Cruz, who is the acting president, is off-island. Diaz is now a volunteer and member of the association.

When asked for comments, Diaz said they are already trying to settle the matter and that they haven’t received a copy of the complaint.

Diaz explained that the check bounced because of sponsorship problems they encountered then. He said they are now very careful with sponsorship deals to avoid facing the same problem.

White stated in the complaint that Leon Guerrero, Cruz, and Diaz are officers and members of the NYBA and are therefore liable for obligations incurred in the association’s name.

White said that on Nov. 24, 2006, NYBA and its officers entered into a contract with World Resort for the hotel to provide food and related services in connection with NYBA’s award banquet.

“Defendants are in default upon the agreement in that defendants have not made the payments,” White said.

The lawyer said that on Nov. 24, 2006, the defendants issued a check in the amount of $2,700 payable to World Resort. White said the check was returned to World Resort due to insufficient funds.

Despite demands for payment, White said the defendants failed and refused to pay.
