CHC sues to collect $145,972 from estate of patient who died 8 yrs ago

The Department of Public Health has filed a lawsuit to collect $145,972 in hospital billings from the estate of a person who died eight years ago.

DPH, through assistant attorney general James R. Stump, sued the estate and the person administering the estate for breach of contract.

DPH asked the Superior Court to order the defendants to pay the Commonwealth Health Center the principal amount of $145,972 plus attorney’s fees, court costs, interest, and collection costs.

Stump stated in the complaint that on July 21, 1998, the patient signed a promissory note for all medical services provided by CHC in the amount of $145,972.

In the promissory note, the patient agreed to make monthly payments of $100.

In the promissory note, Stump said, the patient agreed that, should she breach the agreement, she would be liable for all attorney’s fees and collection costs.

The patient died in 2000.

In September 2000, the government filed a claim against the patient’s estate.

“Defendants breached promissory note on July 2, 2006, when they failed to make the required monthly payment,” Stump said.
