Deportation case vs accident fatality closed

The Superior Court has ordered the closure of the deportation case filed against Rodriguez Jonas Suka, a Chuukese man who was killed when two vehicles struck him one after the other along Beach Road in Susupe.

Associate Judge David Wiseman removed Suka’s case from the court’s docket following the Division of Immigration’s motion to close proceedings as the respondent was killed in a car accident on Jan. 20.

Suka was pronounced dead upon arrival at the Commonwealth Health Center after two cars struck him along Beach Road.

The two drivers were not arrested or cited after traffic investigators determined that they were not under the influence of alcohol and were not speeding.

Chief Prosecutor Kevin Lynch told Saipan Tribune yesterday that, based on his information, Suka was out of jail despite the deportation order because he was allowed to get his travel documents.

Wiseman had ordered Suka’s deportation on Oct. 31, 2008,

Wiseman also ordered that Suka’s travel documents, if any, are to be released to Immigration investigator Nick Reyes for repatriation purposes.

Wiseman ruled that “by clear and convincing evidence” Suka, a citizen from the Federated States of Micronesia—Chuuk—is a deportable alien in that he was convicted of five misdemeanors.

An Immigration investigator earlier also told Saipan Tribune that Suka was released so he could obtain a passport from Guam.
