Ex-Palms staff told to explain lack of action in her lawsuit

The federal court has ordered a former employee of the Palms Resort Saipan to explain why the court should not dismiss for lack of prosecution her discrimination lawsuit against the owner of Palms Resort Saipan.

U.S. District Court for the NMI judge Frances M. Tydingco-Gatewood noted that Jane Quitugua’s case has been pending for more than six months without any action taken by the parties during that period.

“If a proceeding has been pending for more than six months without any action taken by the parties during that period…the court may dismiss the proceeding for lack of prosecution,” said Tydingco-Gatewood.

Quitugua has until July 13, 2011 to respond in writing.

Quitugua sued Micronesian Resort, Inc., owner of Palms Resort Saipan in May 2010, accusing it of “terminating her employment in an unlawful, discriminatory manner.” According to her counsel, Stephen C. Woodruff, Quitugua was removed without advance notice, warning, or explanation.

Quitugua began working for the hotel as a front office supervisor in 1998 and was later promoted to senior assistant front office manager in 2007—a position she held until her termination on Jan. 6, 2009.

Palms Resort had asserted that Quitugua’s termination was simply necessitated by business restructuring.
