BoS asks court to hold debtor in contempt

The Bank of Saipan yesterday asked the Superior Court to compel a debtor to explain why he should not be declared in contempt for violating a court order.

Eric S. Smith, lawyer for the bank, said Antonio S. Guerrero failed to comply with a court judgment directing him to pay BoS.

In Oct. 2001, Smith said the court declared Guerrero in default and assessed against the defendant the amount of $123,201.50 plus interest in a civil action filed by the bank.

In January this year, Smith said the court ordered Guerrero to pay $500 on the outstanding judgment and accruing interests, and $1,000 on the first day of each month beginning March 1, 2004 until the court orders otherwise.

Smith said Guerrero paid some $300 on the judgment on Feb. 6 and some $1,200 on April 8, after which the defendant made no further payment.
