Man arrested for alleged overstaying
Immigration agents arrested a Chinese man while he was attempting to recover his passport from them for allegedly overstaying in the CNMI.
The Attorney General’s Office has asked the Superior Court to deport Xiao Wenzhu. Assistant attorney general Ian Catlett said that Xiao has no lawful documentation to stay in the CNMI as worker or tourist.
Earlier this week, the AGO filed a petition in court, which sought to compel Xiao Wenzhu to explain why he should not be deported. Associate Judge David Wiseman ordered Xiao to appear at a hearing on August 18.
Based on investigation conducted by Immigration investigator John Peter, Xiao was trying to recover his passport from Immigration authorities when he was arrested.
Investigation showed that Xiao entered the CNMI as nonresident worker on May 22, 2001. During his entry, Xiao got paroled and was ordered to report back to Immigration authorities for further review of entry status. Xiao failed to appear before Immigration officers as ordered.
Immigration agents led by Maj. John Taitano arrested Xiao before noon last Friday, Peter said.
