Rota couple sued over $86K debt

The Northern Marianas Housing Corp. filed yesterday a lawsuit against a Rota couple for allegedly refusing to pay an $86,807 debt plus interest.

NMHC asked the Superior Court to order defendants Dexter T. Apatang and Marcia H. Apatang to pay the principal sum plus interest, attorney’s fees and court costs.

NMHC, through counsel Michael White, asked the court to order the sale of the defendants’ mortgaged property in Sinapalo I containing 931 square meters and apply the proceeds as payment.

White stated in the complaint that on Feb. 9, 1999, the Apatangs executed a promissory note in favor of NMHC. The lawyer said the defendants executed a revision agreement in favor of the housing agency.

In the mortgage, the couple pledged their real property in Sinapalo I.

“Defendants are in default upon the note, in that defendants have not made all of the payments provided for therein to be made,” he said.

On Jan. 16, 2006, NMHC sent a notice of default to the defendants.

Notwithstanding demand, White said, the defendants failed to pay.
