THE COURTS First civil suit

The first civil lawsuit for 1999 was filed yesterday in federal court involving violation of the American Disabilities Act.

Bill Nicholson, through lawyer William C. Campbell, filed the action against Interpacific Resorts (Saipan) Corp. dba Pacific Islands Club.

Nicholson has physical disabilities and requires a wheelchair to move around and certain accommodations are necessary to allow him access to public buildings, goods and services.

PIC is subject to the requirement of ADA, but Campbell said its public accommodations are inaccessible to persons with disabilities.

He noted that the accessible parking is not located close to accessible route which is not in compliance with ADA.

PIC’s ramps and slopes are also not in compliance with ADA and the guestrooms are not completely accessible.

There is no signage for alternative accessible route posted anywhere nor proper lighting and egress.

Campbell said PIC could make such public accommodations readily accessible.

PIC’s failure to make all readily achievable accommodations, to remove architectural barriers, to allow access to the public facilities, goods and services violates the ADA, the lawyer said.

Nicholson is asking the court to issue an injunctive relief to require PIC to make all necessary modifications to eliminate all architectural and policy barriers that prevent access by Nicholson and other persons with disabilities.

He also asks the court to stop PIC from violating the ADA and from discriminating against Nicholson and other persons with disabilities.
