Siblings bicker over property

A Guam resident is holding her sister liable for allegedly falsifying bank loan documents that caused her to lose an As Teo property to the Bank of Guam, police said.

Rose Borja filed forgery raps against a former BoG vice president at the Department of Public Safety Tuesday, claiming her 200-by-200 square-meter estate was illegally placed as a collateral in exchange for a bank loan her sister made in April of 1994.

DPS spokesperson Cecil Celes reported yesterday the complainant was approached by the former BoG official sometime in 1994, expressing desire to use the As Teo land owned by Ms. Borja as collateral for a $10,000-loan from the BoG Saipan branch.

Police reports reveal that Ms. Borja agreed to her sister’s request, though she was later told that the suspect’s plan to apply for loan was canceled.

Ms. Borja was, however, surprised to find out from a Saipan lawyer in 1999 that she no longer had rights to her property as it had been seized by BoG to make up for a $99,000-delinquent loan made in 1994.

Lawyer Joaquin Arriola reportedly flew to Guam to inform Ms. Borja of the situation. But the victim now claims she had already sold the As Teo property to a Saipan-based family in 1997.

According to police, Ms. Borja remembers having signed a loan document as per her sister’s request but admitted she only affixed her last name on the papers.

BoG documents reportedly show that the affixed signatures embedded the full name of the collateral owner.

Further, it is also alleged that the suspect provided false information such as a fake mailing address, where all BoG mails have been forwarded to.

The case has been forwarded to the Criminal Bureau of Investigation Office for further probe.
