Man charged with aggravated assault
The Attorney General’s Office criminal division has charged a man in court yesterday with aggravated assault and battery and disturbing the peace.
Chief prosecutor David Hutton said that Agilino P. Elyeisar, 37, “did purposely, knowingly, or recklessly cause serious bodily injury” to a woman on May 13. He alleged that Elyeisar did unlawfully strike, beat, wound, or otherwise do bodily harm against her.
Elyeisar is further charged with disturbing the peace.
Earlier, the Superior Court approved the AGO’s petition to raise Elyeisar’s bail from $25,000 to $50,000 following findings that the victim would be permanently paralyzed.
Police accounts submitted to the court allege that Elyeisar attacked his live-in partner on Sunday morning, May 13.
She reportedly fell on the floor and suffered from great pain.
Elyeisar initially told the police he was sleeping in the bedroom when he was awakened by the victim’s shouts for help after falling.
But the victim’s father, after talking with her in the hospital, told the police that Elyeisar assaulted his daughter, causing her to collapse against a closet.
The father said that Elyeisar got angry at her because she allegedly poured water on the food he was heating up on Sunday morning.
Police accounts said that on Monday, Commonwealth Health Center’s Dr. Austin said two of the victim’s vertebrae at the back of her neck had been dislocated.
Dr. Austin reportedly said that he was able to place them back in the right position but warned that she would continue to experience pain “because of the ligaments that were torn and the nerve damage that would not heal.”
“Dr. Austin further stated that, in his opinion, [the victim] will be permanently paralyzed,” said police officer Roy Kaipat in his report.
Her delicate condition reportedly requires off-island treatment.
