Tooth Works sued for alleged malpractice
Tooth Works was sued by a patient for dental malpractice over a 2003 incident where a dentist allegedly did a root canal on the wrong tooth and dropped an instrument down the patient’s throat.
John Schmanski, a ship’s officer from Michigan, asked the Superior Court to order Tooth Works, its proprietor Todd Johnson, and dentist John Rodan, among other defendants, to compensate him for damages he had suffered.
Loren Sutton, attorney for the plaintiff, said in a complaint filed yesterday that Schmanski was seen at Tooth Works in September 2003 by Rodan.
The dentist diagnosed Schmanski as needing a root canal on one tooth, but performed the treatment on another, Sutton said.
Further, in the course of treating the patient, Rodan allegedly let slip the instrument he was using and dropped it into Schmanski’s throat.
“It was retrieved with a pair of pliers but [it] caused John pain and mental distress that is still ongoing,” Sutton said. “It was necessary for John to engage another dentist at the Seventh Day Adventist Dental Clinic on Saipan to repair the damage done by the defendants. John continues to suffer from headaches and neck pain as the result of the injury.”
Sutton listed the damages Schmanski has suffered or will suffer as: physical pain and mental anguish, loss of earning capacity, physical impairment, dental expenses, medical expenses, and a loss of enjoyment of life.
“[Schmanski] is entitled to damages against the defendants jointly and severally in an amount adequate to compensate them for all damages of any kind, plus all costs, expenses, attorney’s fees, and interest from the date of filing of the complaint,” Sutton added.
