Labor reverses transfer request for four nonresidents workers

Four nonresident workers can finally resume processing their transfer applications after the Department of Labor reversed an earlier order denying their requests to transfer to apparel firm Dong Bang Fashion Corp.

In a Feb 10 hearing, Labor reversed the denial for permit transfer application to Md. Nazrul Sarker, Wei Liu, Daungta Taeshanthiah, and Prajuap Chaichana but not before assessing the company $1,200 in fines for the late filing of deficiencies.

Aside from the monetary sanction, Labor also ordered Dong Bang to submit updated documents as required to complete the applications of the four nonresident workers.

The documents include the nonresident workers’ health certificate, police clearance, Job Vacancy Announcement, and a business establishment inspection clearance for Dong Ban.

A fifth nonresident worker, Manchang Li, however was not as lucky as his denial of transfer relief was affirmed by Labor after Dong Bang said it was no longer interested in his services.

Manchang was given 45 days to find a new employer otherwise he would be repatriated back to his country.

According to Labor, Sarker, Liu, Chaichana and Li applied for transfer to Dong Bang as security guards and Dong Bang filed all four applications on Feb. 20, 2004.

On that same day, Labor provided a deficiency notice to Dong Bang regarding application documents but the company failed to submit the additional required documents within 10 days.

Months passed and Dong Bang failed to comply with the notice, forcing Labor to originally deny the four applications for transfer relief on June 16, 2004. Taesanthiah also suffered the same fate, as the nonresident worker’s transfer application with Dong Bang was denied earlier on April 21, 2004.

Dong Bang was given notices through mail but failed to notify the workers until last January. The new personnel manager of Dong Bang learned about the issue and immediately filed for reconsideration.

Though Labor later recommended that the denial be reversed, Labor found Dong Bang still negligent on correcting the deficiencies for several months and sanctioned Dong Bang the $300 fine for each of the four workers.
