Worker ordered to leave NMI

The Department of Labor has ordered a nonresident worker to leave the Commonwealth after he missed three hearing schedules for his case.

Labor hearing officer Maya B. Kara said Xu Yunfu no longer has valid work status to remain in the CNMI and should depart within 20 days.

Kara instructed Xu’s former employer, Al Mamun Abdullah, to pay for his repatriation ticket. She said Xu’s name would be forwarded to the Attorney General’s Office for possible deportation proceedings if he fails to leave the CNMI before the deadline given.

The labor administrative order stemmed from the late filing of Xu’s application.

Xu’s prior six-month permit as a farmer for Abdullah expired on July 22, 2004. However, Abdullah did not file an application to renew Xu’s employment until two months later.

On Nov. 18, 2004, the Division of Labor denied the application for untimely filing.

Three hearing dates were set for the appeal of the denial. Xu failed to show up at any of the hearings, despite having been served by publication on the third time.

“He did not contact the Hearing Office at any time nor did he show good cause for his failure to appear. Accordingly, the appeal is subject to dismissal and should be dismissed,” said Kara.
