2 workers allowed to seek new employers

Two nonresident workers were given 45 days to find new jobs after getting favorable results in federal cases they had filed against their respective previous employers.

This came as Department of Labor hearing officer Herbert D. Soll granted the requests of workers Niranjan Niranjan and Thi Thuy Van Nguyen to transfer to new employers.

Niranjan has received a favorable decision from the U.S. Department of Labor in the complaint he had filed against his former employer, Kanda International Inc. and Albert Lee.

Nguyen, who sued Neo Fashion Inc. in the U.S. District Court, entered into a settlement agreement with his former employer. As part of the settlement, Neo Fashion agreed to not object to a transfer of employers by Nguyen.

Soll said that such terms of the settlement were “construed as a favorable result to the complainant.”

In separate administrative orders, Soll noted that Section IV of the Alien Labor Rules and Regulations provide grounds for transfer in both cases.

“[The] complainant’s request for time in which to transfer is granted,” Soll ordered. “The complainant shall have a period of 45 days from the date of this order to have filed on her behalf an application for a nonresident work permit for the approval and processing by the Department of Labor.”
