Lessee who allegedly abandoned land sued

A landowner yesterday sued a Korean national whose whereabouts he could not ascertain years after the latter leased his Saipan land for 55 years.

Francisco C. Aguon filed with the Superior Court a civil action that seeks to terminate the lease agreement he struck with Lee Kwan Hun on Sept. 28, 1991. Aguon asked the court to restore the land to his possession.

The lease involves a 980-square meter land and was supposed to expire in 2046, according to Danilo T. Aguilar, Aguon’s lawyer.

On the day Aguon and Lee entered into the lease agreement, the Korean paid the landowner some $39,600 as initial payment for the lease, Aguilar said.

But the lawyer added that Lee made no payment to Aguon thereafter. Aguilar said Lee’s breach of the lease agreement has been affecting Aguon’s rights over the land.

He said the lease agreement should be terminated and Aguon should be entitled to a peaceful possession of his land.
