Hotel sued over alleged non-payment of gas supply

An operator of gasoline stations has sued Hotel Riviera Saipan Inc. and its manager and general manager for allegedly refusing to pay $9,255 as payment for diesel gas supply.

AA Enterprises Inc. sued Hotel Riviera Saipan Inc., its manager Jun Young Lee, and general manager Mi Ran Jang, for breach of contract.

AA Enterprises, through lawyer Robert T. Torres, asked the Superior Court to order the defendant to pay the principal sum, plus interest, attorney’s fees, and court costs.

Saipan Tribune contacted yesterday the managers to get their side, but they were not available.

Torres stated in the complaint that on July 25, 2008, his client provided diesel gas to Hotel Riviera Saipan in the amount of $4,720.

The lawyer said Hotel Riviera Saipan paid $1,585 on Sept. 18, 2008, and $2,000 on Oct. 1, 2008, leaving a balance of $1,135.

Torres said that on Aug. 8, 2008, AA Enterprises again provided diesel gas to the defendant in the amount of $4,088, but no payments were made upon this invoice.

He alleged that on Aug. 9, 2008, again AA provided diesel gas to the defendant in the amount of $4,032, but no payments were made again.

Torres said that on Nov. 1, 2008, his client sent a statement of account, showing the total amount owed at $9,255.

“Notwithstanding each demand and notice, defendant failed, refused, and neglected, and still fails, refuses, and neglects to pay the full sum owed to the plaintiff,” the lawyer said.
