Elliot fails to show up in court—again
As expected, Eria Elliot did not show up in court—again—for his scheduled hearing yesterday morning.
Only chief prosecutor Kevin Lynch and Elliot’s counsel, chief public defender Adam Hardwicke, appeared in the Superior Court for the status conference.
This prompted associate judge David A. Wiseman to issue another bench warrant against the 28-year-old Elliot.
Wiseman ordered Department of Public Safety Commissioner Santiago F. Tudela to arrest Elliot and bring to court immediately.
The judge imposed a $1,000 cash bail.
Last Thursday, Wiseman issued a bench warrant against Elliot for non-appearance at his hearing.
The defendant was arrested and brought to court last Friday. Associate Judge Kenneth Govendo released him and ordered him to return for the status conference supposedly for yesterday.
Associate Judge Ramona V. Manglona had issued at least two bench warrants against Elliot for non-appearance.
Elliot has four pending criminal cases, mostly for allegedly assaulting and harassing people.
The defendant is regularly seen roaming the island’s streets and entering establishments to ask for food and money from passersby, customers, and tourists.
He has been admitted several times to the Commonwealth Health Center for acute psychosis related to alcohol and marijuana abuse.
A psychiatrist in 2006 found Elliot to be suffering from schizophrenia and has dilatory hallucinations. The psychiatrist, however, determined that he was competent to stand trial.
Saipan Tribune learned yesterday that Elliot is not a Palauan. His father is a Caucasian who used to work at the Superior Court.
